BOARD OF ZONING APPEALS
PUBLIC NOTICE

A public hearing and meeting will be held before and by the Board of Zoning Appeals of the Incorporated Village of Mill Neck, Nassau County, New York, at the Village Hall, 32 Frost Mill Road in the Village on October 30, 2024, at 6:00 p.m. 

The hearing will be on the application of The Barn at Mill Neck LLC, owner of a parcel of land located at 127 Horseshoe Road in the Village, designated as Section 29 Block L Lot 42 on the Nassau County Land and Tax Map and The Chimneys LLC, owner of a parcel of land located at 127 Horseshoe Road in the Village, designated as Section 29 Block L Lots 33 & 714 on the Nassau County Land and Tax Mapin the Village=s E‑1 (5-acre) Zoning District.            

            In connection with an application currently pending before the Village Planning Board to partition the property into two (2) lots, the Appellants seek the following variances:

            PARCEL’A’ 

  1. Brick wall and steps having a westerly side yard setback of 12.8 feet rather than the minimum required 75.0 feet
  2. Concrete wall and steps having a westerly side yard setback of 27.9 feet rather than the minimum required 75.0 feet.
  3. Fountain having a westerly side yard setback of 34.1 feet rather than the minimum required 75.0 feet.
  4. Greenhouse having a front yard setback of 86.0 feet rather than the minimum required 125.0 feet and located forward of the rear line of the main dwelling to which it is accessory.
  5. 2 Story frame dwelling/garage having a front yard setback of 4.4 feet rather than the minimum required 75.0 feet.
  6. 1 ½ story frame accessory dwelling having a front yard setback of 14.3 feet rather than the minimum required 125.0 feet and located forward of the rear line of the main dwelling to which it is accessory, and an easterly side yard setback of 38.3 feet rather than the minimum required 75.0 feet.
  7. Tennis court having a front yard setback of 109.3 feet rather than the minimum 125.0 feet and an easterly side yard setback of 56.3 feet rather than the minimum 75.0 feet.
  8. Pool patio having an easterly side yard setback of 58.8 feet rather than the minimum required 75.0 feet.
  9. In-ground pool having an easterly side yard setback of 64.9 feet rather than the minimum required 75.0 feet.
  10. Doll house having an easterly side yard setback of 73.1 feet rather than the minimum required 75.0 feet.
  11. Pool equipment having an easterly side yard setback of 66.4 feet rather than the minimum required 75.0 feet.

PARCEL’B’ 

  1. 2 Story brick dwelling/garage having a westerly side yard setback of 36.3 feet rather than the minimum required 75.0 feet and a front yard setback of 58.6 feet rather than the minimum required 125.0 feet and is forward of the rear line of the main dwelling to which it is accessory.

The above application is on file at the office of the Village Clerk located at 32 Frost Mill Road between the hours of 9:30 a.m. and 12:30 p.m., Monday through Friday, until the time of the hearing. 

All interested parties will be given an opportunity to be heard at said time and place.
