BOARD OF ZONING APPEALS
PUBLIC NOTICE

A public hearing and meeting will be held before and by the Board of Zoning Appeals of the Incorporated Village of Mill Neck, Nassau County, New York, at the Village Hall, 32 Frost Mill Road in the Village on June 26, 2025 at 6:00 p.m. 

The hearing will be on the application Thomas Posillico, owner of a parcel of land located at 5 Frost Mill Road in the Village, designated as Section 29 Block R-3 Lot 310 on the Nassau County Land and Tax Map in the Village=s E‑1 (5-acre) Zoning District. 

            The Appellant seeks variances to permit the following construction:

  1. An inground pool which would be located closer to the front lot line than the rear building line of the main dwelling to which it is accessory, and which would have a front yard setback of 45’10” rather than the required 125 feet and a side yard setback of 65’11” rather than the required 75 feet;
  2. Pool patio which would be located closer to the front lot line than the rear building line of the main dwelling to which it is accessory, and which would have a front yard setback of 46’11” rather than the required 125 feet and a side yard setback of 52’ rather than the required 75 feet;
  3. Pool equipment which would be located closer to the front lot line than the rear building line of the main dwelling to which it is accessory, and which would have a front yard setback of 48’9” rather than the required 125 feet;
  4. Detached three-car garage which would have a side yard setback of 70’9” and a rear yard setback of 14’1” rather than the required 75 feet;
  5. Tennis court which would have a rear yard setback of 41’5” rather than the required 75 feet.

The above application is on file at the office of the Village Clerk located at 32 Frost Mill Road between the hours of 9:30 a.m. and 12:30 p.m., Monday through Friday, until the time of the hearing. 

All interested parties will be given an opportunity to be heard at said time and place.
