BOARD OF ZONING APPEALS
PUBLIC NOTICE

A public hearing and meeting will be held before and by the Board of Zoning Appeals of the Incorporated Village of Mill Neck, Nassau County, New York, at the Village Hall, 32 Frost Mill Road in the Village on March 23, 2026 at 6:00 p.m. 

The hearing will be on the application Diego E. Fuschetto & Carolina Reynolds, owners of a parcel of land located at 150 Factory Pond Road in the Village, designated as Section 29 Block R-3 Lot 311 on the Nassau County Land and Tax Map in the Village’s E‑1 (5-acre) Zoning District.            

            The Appellants seeks variances to permit the installation of a generator and air conditioning condensing units adjacent to the east side of the main dwelling which will require the following variances:

  1. To allow the generator to have a front yard setback of 74 feet rather than the required 125 feet and a side yard setback of 63 feet rather than the required 75 feet, and to be located closer to the front lot line than the rear line of the main dwelling to which it is accessory;
  2. To allow the air conditioning units to have a front yard setback of 72 feet rather than the required 100 feet, side yard setback of 67 feet rather than the required 75 feet and located closer to the front lot line than the rear line of the main dwelling to which it is accessory.

The above application is on file at the office of the Village Clerk located at 32 Frost Mill Road between the hours of 9:30 a.m. and 12:30 p.m., Monday through Friday, until the time of the hearing. 

All interested parties will be given an opportunity to be heard at said time and place.
