VILLAGE OF MILL NECK
BOARD OF ZONING APPEALS
PUBLIC NOTICE
A public hearing and meeting will be held before and by the Board of Zoning Appeals of the Incorporated Village of Mill Neck, Nassau County, New York, at the Village Hall, 32 Frost Mill Road in the Village on February 15, 2024 at 6:00 p.m.
The hearing will be on the application of Jessica and Bryan Valdivia, owners of a parcel of land located at 242 Cleft Road in the Village, designated as Section 29 Block N Lot 228 on the Nassau County Land and Tax Map, in the Village=s E‑1 (5-acre) Zoning District.
The Appellants seek variances to permit the construction of an in-ground swimming pool and filter/heater equipment which will require the following variances:
- To allow the swimming pool to have a front yard setback from Cleft Road of 71.3 feet rather than the required 125 feet;
- To allow the swimming pool to have a southerly side yard setback of 10 feet and a rear yard setback of 17 feet rather than the required 75 feet;
- To allow the swimming pool filter/heater equipment to have a rear yard setback of 21.5 feet rather than the required 75 feet;
- To allow the swimming pool and filter/heater equipment to increase the total lot coverage of the principal and all accessory structures to 14.7% of lot area (2,532.6 square feet) rather than the maximum permitted 10% of lot area (1,725.3 square feet).
The above application is on file at the office of the Village Clerk located at 32 Frost Mill Road between the hours of 9:30 a.m. and 12:30 p.m., Monday through Friday, until the time of the hearing.
All interested parties will be given an opportunity to be heard at said time and place.
